SGI maintains the privacy of your personal information and personal health information in accordance with the law and this notice. We protect your personal information by:

  • Limiting employee access to your personal information and personal health information - only employees who need to know your information to do their job can access your personal information.
  • Maintaining physical, electronic and procedural safeguards to keep your personal information and personal health information safe and confidential.
  • Our employees annually sign a Confidentiality and Non-Disclosure Agreement to protect and hold your personal information in confidence.
  • Most access to our system, internally or externally, leaves a footprint. Those monitored transactions leave a trail of the access code of the person using the system and the day, time and what customer information was accessed.
  • If we share your information with a 3rd-party service provider, we give them the least amount of information needed to provide the service we require, restrict their ability to use the information for any other purpose and require them to keep your information safe and hold it in confidence.

Accessing your information

Subject to any lawful restriction, you have the right to obtain a copy of the personal information or personal health information SGI collects about you and may request an amendment to any information on your file that is incorrect. To ensure that we have accurate information, please notify us when there are changes to your personal information.

Definitions

collect - to gather, receive or record personal information or personal health information from any source, in any format and by any means

disclose - to make personal information or personal health information available outside of SGI

personal information - information about an identifiable individual - does not include aggregate information that cannot be associated with a specific individual

personal health information - information with respect to the physical or mental health of an individual including any health services received

SGI - SGI and its affiliates1

3rd party - an individual or organization other than the customer, the customer's agent or SGI

use - the treatment, handling or management of personal information by SGI

Information SGI collects

SGI collects your personal information and personal health information to conduct our business. Whenever possible we collect this information directly from you and with your consent. However, there are times when SGI will collect information about you from other insured persons, witnesses, law enforcement, technical experts we hire, hospitals, health care providers, medical practitioners, credit companies, underwriting tracking systems, other insurance companies, insurance brokers, our affiliates and other government ministries. For example, your doctor or optometrist must notify SGI if a medical condition makes you unfit to drive a motor vehicle. Depending on the service or product you require, SGI may collect and retain the following information.

For driver licensing and vehicle registration:

  • name, address, home and work phone numbers, fax numbers, email address and cellphone number
  • date of birth, age, gender and marital status
  • your photograph and signature
  • driver testing information
  • driving record including collisions, licence suspensions, convictions, traffic violations, the class of licence you hold, any restriction on your licence, and your safe driver or business recognition rating
  • personal health information.
  • information regarding participation in regulated driver programs (e.g., ignition interlock, DWI courses, etc.)
  • money owing to SGI and payment history
  • banking information
  • vehicle information
  • commercial driving records and logs required to be completed by law, inspection outcomes relating to Carrier Audits for National Safety Code Certificates, driver and vehicle list, claim history, safety violations, etc.

For provincial driving training program:

  • driver licensing information and driver record information on all certified driver training instructors
  • personal health information
  • criminal record checks
  • job performance, professional development information, and education transcripts on all certified driver instructors
  • driver training school records including student marks, driver testing information and attendance records

For automobile injury benefits:

  • name, address, home and work phone numbers, fax numbers, email address and cellphone number
  • date of birth, age, gender, marital status, number of dependants and family status
  • names and ages of your spouse, children and other dependants
  • education, work history, current employment status including the name and address of your current employer
  • financial and business information (e.g., wages, banking information, income tax returns, etc.)
  • lifestyle information (e.g., homemaking responsibilities, etc.)
  • personal health information including current and prior health claims, any past treatments, medical conditions, injuries, or insurance or disability claims, a claim under Workers' Compensation, or any entitlement regarding other insurance programs or policies that may be important for determining your entitlement to injury benefits
  • hospitalization number
  • blood alcohol readings, collision reports and vehicle damage information
  • entitlement to other government benefit programs (e.g., social assistance)
  • other government identification numbers

SGI is administrator of Saskatchewan’s compulsory automobile insurance program under The Automobile Accident Insurance Act. This program provides Saskatchewan residents with insurance coverage if they are injured in a motor vehicle collision. If you are seeking to obtain automobile injury benefits, the Act requires our customer to provide SGI with personal information and personal health information to determine entitlement to the statutory benefits under this program. If you do not provide SGI with the personal information requested, you can be denied benefits. SGI does not request more personal information or personal health information than required, but the nature of your claim or the injuries you sustain may require SGI to collect a significant amount of information.

Regulating our collection

On occasion, as a result of requesting your personal health information to determine your entitlement to SGI’s automobile injury benefit program, SGI may obtain more personal health information than necessary to determine your entitlement to benefits. In these situations, SGI will make every effort to ensure that the unnecessary personal information is removed from your file where that information is easily separated from the personal health information SGI requires to determine your benefit entitlement. SGI will destroy that information in a confidential manner. If you have any concerns in this regard, please contact us for assistance.

For employment purposes:

SGI retains a database on individuals who have sought employment with SGI. This database retains all information provided to SGI by an applicant on the application for employment or in an applicant's resume. In addition, SGI retains the results of any employment or skill tests conducted by the applicant at SGI’s request for the purpose of determining a candidate’s suitability for employment. This information is held by the company exclusively for the purpose of recruitment and hire.

For adjusting an insurance claim:

  • name, address, home and work phone numbers, fax numbers, email address and cellphone number
  • age, gender, marital status and family status
  • driving record including collisions, licence suspensions, convictions, traffic violations, the class of licence you hold, any restriction on your licence, and your safe driver or business rating
  • vehicle information
  • financial information including credit card information, credit rating, payment history, tax returns, etc.
  • property information (e.g., mortgage or leasing information, etc.)
  • blood alcohol readings and collision reports from law enforcement
  • commercial driving records and logs required to be completed by law, inspection outcomes relating to Carrier Audits for National Safety Code Certificates, driver and vehicle list, claim history, safety violations, etc.
  • prior insurance claim history
  • any information needed to adjust the present claim (e.g., witness statements, damage estimates, claim file investigations, property valuations, etc.)

For providing an insurance policy:

  • name, address, home and work phone numbers, fax numbers, email address and cellphone number
  • age, gender, marital status and family status
  • driver's licence number, driving record including collisions, licence suspensions, convictions, traffic violations, the class of licence held, restriction on the driver's licence and safe driver or business rating information
  • vehicle information
  • financial information including banking information, credit card information, credit rating, payment history and tax returns
  • property information (e.g., property values, mortgage or leasing information, etc.)
  • money owed to SGI and payment history
  • prior claim history and any information needed to adjust those prior claims (e.g., witness statements, damage estimates, claim file investigations, etc.)
  • commercial driving records and logs required to be completed by law, inspection outcomes relating to Carrier Audits for the National Safety Code Certificates, driver and vehicle list, claim history, safety violations, etc.
  • information about your transactions with us and products and services you use

Information SGI uses

The personal information described above is shared between various departments within SGI and with our business partners (e.g., licence issuers, lawyers, process servers, medical or financial consultants, and other technical experts) for business purposes.

Below are the business reasons for sharing your personal information within the corporation.

For driver licensing and vehicle registration:

  • To determine entitlement to a driver's licence or vehicle registration and/or provide Saskatchewan residents with photo identification, a driver's licence or vehicle registration.
  • To administer driver licensing and vehicle registration programs pursuant to The Traffic Safety Act and its regulations.
  • To regulate and address road safety issues.
  • To provide commercial carriers with a National Safety Code certificate and monitor safety compliance of commercial carriers.
  • To monitor the performance of driver and vehicle inspection stations, dealers, driving school and driver trainers.
  • To communicate with motor licence issuers about their customers' needs.

Many organizations seek to collect or retain a copy of your driver's licence or photo identification for other reasons (e.g., to verify identity or prevent fraud). We remind you to use caution when providing this information to others. Ask the organization why they require the information and whether it is being stored. You should also protect your information against unauthorized access by others who may acquire it and use it without your consent.

For provincial driving training programs:

  • To determine entitlement to a driver instructor certificate or a driver training school certificate.
  • To provide and monitor the provision of driver training in the province.

For automobile injury benefits:

  • To determine your entitlement to and/or provide individuals and their families with the benefits they are statutorily entitled to receive if injured in a motor vehicle collision.

For adjusting an insurance claim:

  • To determine your entitlement to and provide insurance coverage under The Automobile Accident Insurance Act or as a result of an SGI/SGI CANADA insurance policy.
  • To detect, investigate and prevent fraud.

For providing an insurance policy:

  • To underwrite risks on a prudent basis.
  • To detect, investigate and prevent fraud.
  • To communicate with brokers about their customers' needs.

For general business needs:

  • To verify your identity.
  • To respond to inquiries, questions and concerns, and to communicate with our customers.
  • To assist customers with insurance financing options (e.g., AutoPay or the Deductible Payment Plan).
  • To conduct litigation that arises out of our business including collecting a debt or enforcing an obligation owed to us by you.
  • To conduct business audits.
  • To conduct surveys and internal business analysis, gather broad demographic information, compile statistics, and develop products and services.
  • To respond to your requests for access to information, privacy concerns or requests for corrections in your personal information.
  • To comply with the law.
  • To conduct public education and loss prevention campaigns regarding insurance concerns.
  • To improve business processes and business systems through secured data testing.

Information SGI discloses

If you request or consent to the release of your information to a 3rd party, SGI will release your information as requested. For example, when you access your SGI information on the MySGI website and associate yourself with an issuer, you are agreeing to the release of your driver licensing and vehicle registration information to that issuer.

SGI is required to comply with The Freedom of Information and Protection of Privacy Act. This Act not only sets out our obligations to protect your personal information, but indicates when that information may be disclosed without your consent.

Without your consent, we can share your information:

  • To respond to a subpoena, warrant, court order or other comparable legal process.
  • With other departments within SGI and our affiliate companies.
  • With law enforcement for enforcing the laws or carrying out a lawful investigation.
  • With other municipal, provincial and federal government ministries and agencies for determining eligibility for programs and services, and for investigating fraud.
  • With the Registrar of Motor Vehicles in other jurisdictions for licensing and registration purposes.
  • With our service providers who deliver a service or program on our behalf (e.g., independent adjusters, lawyers, accountants, medical experts, etc.).
  • With the ombudsman.
  • With the privacy commissioner.
  • With the War Amps (name and address of a driver only).
  • With a lawyer acting for an individual involved in a motor vehicle collision (name and address of vehicle owner only).
  • With collection agencies, health districts, universities, etc. (name and address of vehicle owner only for parking enforcement).
  • With Canada Revenue Agency for collecting money owed to the Government of Saskatchewan or Canada.

For driver's licences:

SGI does release your driver's licence information to our driver's licence supplier and motor licence issuers to assist us in serving you. The release of this information is subject to strict confidentiality requirements.

For automobile injury benefits:

The collection of your personal health information for no-fault injury benefits is used only by the SGI Claims Division; it is not shared with other departments in SGI other than SGI's Medical Review Unit. Information is only shared with the SGI Medical Review Unit in a situation where the personal health information collected by SGI during the administration of your injury benefits indicates you have a medical condition that may impact on your ability to drive a motor vehicle.

Your personal health information is only disclosed by SGI for the purpose of providing you with automobile injury benefits. Unless required by law, we do not share your personal health information with our affiliates or with any 3rd parties except to provide you with injury benefits. Your personal health information may be disclosed to medical consultants, lawyers or other professional experts (e.g. vocational or rehabilitation consultants, physiotherapist, etc.) SGI hires to assist them in determining your entitlement to benefits, your rehabilitation needs, the extent of your injuries from a motor vehicle collision, and the type of treatment that your insurance coverage must provide. Subject to a legal requirement to disclose your information, the confidentiality of your personal information and personal health information is a requirement of any disclosure. If you appeal a decision SGI makes regarding your entitlement to benefits to either the courts or the Automobile Injury Appeal Commission, SGI may disclose your personal health information for the purpose of defending its decision.

General comments

Please note SGI often releases de-identified personal information to other businesses to facilitate our business needs (e.g., reinsurance companies).

Retention and destruction of information

We keep your information only as long as we need it:

  • to provide the business products and services identified
  • to meet any legal or regulatory requirements

When we no longer require or need your personal information, it is destroyed in a confidential manner.

What if you believe your privacy rights have been violated?

First, contact SGI's Privacy Department. An officer will review your concerns and try to resolve them. If you are not satisfied with the outcome of an inquiry or complaint, you may address your concerns to:
